Entering a Plea - NO CONTEST or GUILTY
If you do not wish to contest your citation, fill out and print the form located here, or use the one in the pamphlet that was given to you at the time the citation was issued. Mark "guilty or no contest" on the form and mail it to: If you are required to appear in court, or if you wish to appear in court to plead "guilty" or "no contest" before the Municipal Judge, you must appear at the following location on the date and time noted on your citation: Please refer to payment information on how to pay for your citation. After making payment on your citation, the process is finished. Entering a Plea - NOT GUILTY If you enter a plea of not guilty, your case will be scheduled for a Pretrial Conference with the prosecuting attorney. If the case is not resolved at the Pretrial Conference, the case will then be scheduled for a Trial to the Court. Be advised that if you plead not guilty, your case will not be heard at the initial court date that was written on your citation; instead, you will be given a new court date. All Pretrial Conferences are MANDATORY COURT APPEARANCES. This form must be received no later than one day prior to the court date written on your citation. Operating While Intoxicated/Operating With a Prohibited Alcohol Concentration Citations If you have been charged with a violation of Operating While Intoxicated or Operating With a Prohibited Alcohol Concentration, you are entitled to a Jury Trial on a plea of not guilty. You must file a written request for a jury trial within ten (10) days of your initial court date. You must also pay the required jury fee and post the bond amount noted on your citation. If you fail to comply according to Wisconsin Statutes, your case will be scheduled for a Pretrial Conference and then a Trial to the Court if the case is not resolved at the Pretrial Conference. Payment Information If you are mailing your payment to the Mid-Moraine Municipal Court, make your check or money order payable to "Municipal Court". If paying in person, you can pay with a check, money order or cash. Credit card payments are taken through Government Payment Services (GPS) and there is a fee for using this service. To charge the amount you owe on your credit card, please call 1-888-604-7888. To Avoid Any Additional Costs Your payment must be received at the Mid-Moraine Municipal Court office in West Bend, Wisconsin on or before the court date noted on your citation. If you fail to pay your citation by the court date and do not appear for court, the Court will enter a "no contest" plea on your behalf (the default judgment). A default notice will be mailed to you and a $5.00 default fee will be added to your fine. If payment is then not received after this, the Mid-Moraine Municipal Court system will then proceed to process a warrant in your name for failure to pay forfeiture, which includes additional fees.
The Port Washington Police Department, along with several other area police departments, utilizes the Mid-Moraine Municipal Court system. If you have been issued a citation by the Port Washington Police Department, below are the steps you need to follow to take care of your citation. If you have been issued a citation by any other police or sheriff's department, you need to contact that department to find out how to take care of your citation. To plead not guilty, you need to do ONE of the following:

If you would rather fax the form directly to court, the fax number is 262-677-4338. Again, this form must be received no later than one day prior to the court date written on your citation. You will be notified of your new court date via the U.
S. Mail, approximately one week after the intial court appearance date that appears on your citation. DO NOT APPEAR FOR COURT ON THE DATE WRITTEN ON YOUR CITATION. You will be notified by mail when to appear for court.
2. Go to the Mid-Moraine Muncipal Court administrative office, located at the address above, and complete a Not Guilty Plea form and you will receive a new court date immediately.
3. Appear at the following location on the date and time written on your citation:

If the citation you received includes restitution (as in the case of issuance of worthless check, retail theft, theft, or property damage), you will not be allowed to make payment by check.
